ePahichan terms of service

Who these terms are between
ePahichan is a digital identity and digital signature app for Nepal. It is built and run by Ninja Infosys Pvt. Ltd., Anamnagar, Kathmandu (“we”). Digital signature certificates are issued by Nepal Certifying Company (“NCC”), the licensed certifying authority. ePahichan is not a government service. By creating an account or using the app or API you agree to these terms.
Your account
- You must be 18 or older.
- Sign in is by your mobile number and a code sent by SMS. Keep your phone and your unlock method (fingerprint, face or passcode) to yourself.
- Give true details. A certificate application with false details will be refused or revoked.
- You are responsible for what is done with your account and your signing key. Tell us and NCC promptly if your phone is lost or you think someone else has used your key.
Your certificate
- Your certificate is issued, suspended, renewed and revoked by NCC under its own policy and the Electronic Transactions Act, 2063. We pass your application to NCC and show you its result.
- Fees for a certificate or its renewal are shown in the app before you pay. They are paid through Fonepay or a bank or wallet app.
- A certificate that has expired or been revoked cannot be used to sign.
Signing documents
- A signature you make is made with your certificate and binds you in the way the law gives it effect. Read a document before you sign it.
- A digital signature is valid for a legal signature requirement only when made by the procedures in the Act and its Rules, and only for documents the Act covers. Some documents are outside the Act, for example deeds that transfer title to immovable property, wills, negotiable instruments and powers of attorney. Do not use ePahichan to sign those and expect the Act to apply.
- A signature shows who signed what. It does not by itself show when. Do not rely on a signing time shown on a device as proof of time.
- Signed documents you send to others can be kept by them, and we cannot recall them.
Using the API
- API access is given to an organization after NCC onboards it. Keep your keys on your server and never in an app or a public repository.
- Test requests in the sandbox are not legal signatures.
- You may not use the ID check API to look up people who have not asked you to, or to collect records. Each check is for a person who is dealing with you.
What you must not do
- Use ePahichan to break the law, to forge or alter documents, or to sign for another person.
- Try to get around its security, rate limits or access controls.
- Interfere with the service or with other users.
Our responsibilities
We run ePahichan with reasonable care and aim to keep it available, but we do not promise it will never be interrupted. We are not responsible for the contents of documents you sign, for decisions made by NCC, or for an outage of a service we depend on, such as SMS delivery or a payment provider. Nothing in these terms limits a right you have under Nepali law that cannot be limited.
Your data
How we handle your data is in the privacy policy. You can delete your account at any time. See how to delete your account.
Changes and law
We may update these terms. The new version is posted here with a new date, and continued use means you accept it. These terms are governed by the laws of Nepal and disputes are for the courts of Nepal.
